Legal Update Of Civil Procedures Through The Judges 'Rules: Review Of Judgments Of Traditional Heritage Court

Abstract

Law, Judge's Verdict, Judge's consideration is one of the most important aspects in determining the realization of the value of a judge's verdict that contains justice (ex aequo et bono). In this research, the researcher will try to examine the role of court judges' verdicts in settling customary inheritance law based on legal justice to renew civil procedural law in Indonesia. Normative juridical research methods on principles, systematics of law, legal synchronization, and comparative law. The court verdict must not only contain certain articles of the relevant regulation or an unwritten source of law which is used as the basis for exploring the laws that live and develop in society. All court verdicts, apart from having to contain certain articles of the relevant regulations or sources of unwritten law, are used as the basis for exploring legal principles that live and develop in society. Some of the Jurispudence of Court Verdicts on inheritance law were issued "in line with the times" in relation to the renewal of customary inheritance law through court verdicts.
